Large Trees on Sloped Ground
Tree removal in Montclair is shaped by the hill. The township climbs the east side of the First Watchung Mountain, rising to around 299 feet at its official elevation point and higher toward the ridge, where some higher spots look out at the New York City skyline about 12 miles away. A tree on a slope leans its weight downhill, and every piece that comes off it wants to roll that way too.
That is why our first step on a Montclair job is reading the grade. We look at where the house, retaining walls, steps and driveway sit below the tree, then decide which limbs get lowered on ropes, which can drop, and whether a crane from the street is the safer way to lift sections over the roof.
What Chapter 324 covers
Montclair's Ordinance for the Preservation of Shade Trees applies to trees on all property in the township, including private yards (§ 324-3). It treats a tree as a shade tree once it measures eight inches or more in diameter at four and a half feet up, on the downhill side, or once it reaches 25 feet tall (§ 324-2). Removing one, or altering it substantially, requires a permit before work begins. Routine yearly pruning and pruning after storm damage are not counted as substantial alteration.
Replacing what comes down
Under § 324-5, a removed tree is generally expected to be replaced with a new tree of two to two and a half inch caliper, chosen from native or urban-suitable species. The code lists a $250 payment into the township's Tree Fund as an alternative; ask the township which option fits your case. If you plan to replant, we grind the stump and clear the roots near the surface so the new tree has room.
Fees, contractors and emergencies
- The application fee is $15 per tree (§ 324-8), waived for diseased or hazardous trees, invasive exotic trees and documented hardship
- Only a contractor registered with the township may do the removal, and that contractor endorses the permit application (§ 324-4A)
- No permit is needed where there is an immediate safety risk to people or property (§ 324-3C)
Confirm the current rules with the township at 973-744-1400 before removal.
Older homes and historic districts
Montclair has six historic districts on the state and national registers and 92 individually listed landmarks. Mature trees on these properties can stand close to slate roofs, stone walls and old porches. We work slowly around them, lowering wood in small pieces and laying protection over walks and plantings, then haul off every log and branch. Call (201) 957-7596 to set up a free estimate.
Montclair Details for Tree Owners
- Eight inches or 25 feet. Montclair Code § 324-2 defines a shade tree as one with a diameter of eight inches or more at 4 1/2 feet, measured on the downhill side, or one at least 25 feet tall. The rules apply on private property as well as public land.
- Replant or pay $250. § 324-5 calls for replacing removed trees with a 2 to 2 1/2 inch caliper native or urban-suitable tree and lists a $250 Tree Fund contribution as an alternative. Check with the township before relying on either route.
- First Mountain terrain. Montclair sits on the east side of the First Watchung Mountain, with an elevation of 299 feet, and higher spots look toward the New York City skyline about 12 miles away.
- High-value homes. Census figures put Montclair's median owner-occupied home value at $906,400 (2020 to 2024), with a 56.9% owner-occupied rate and 40,921 residents counted in 2020.
- An Olmsted-designed park. Anderson Park, 14.85 acres donated in 1903, was designed by John Charles Olmsted and added to the National Register of Historic Places in 2009.

Montclair Questions
My tree is only about 20 feet tall. Does Montclair's permit rule still apply?
It can. The code counts a tree as a shade tree if it is eight inches or more across at four and a half feet, measured on the downhill side, even if it is under 25 feet tall. We measure during the estimate, and you can confirm with the township.
How do you take down a tree that stands uphill from my house?
We remove it from the top down in small sections, lowering each one on ropes so nothing rolls toward the house. When the slope or the roof makes that too risky, we use a crane from the street to lift pieces clear.
Should I replant or pay into the Tree Fund?
§ 324-5 lists a $250 contribution to the Tree Fund as an alternative to a replacement tree; confirm with the township which applies to your removal. Replanting keeps shade on your own lot, while the payment may suit a yard with no good spot. If you replant, we can grind the stump and leave the area ready for the new tree.
A limb broke in last night's storm. Do I need a permit to cut it?
As the code reads, it does not count pruning after weather damage as substantial alteration, and it allows removal without a permit where there is an immediate safety risk. Check with the township, stay off ladders near power lines, and phone us at [PHONE].
